Understand What You Need to Prove

Typically, this means showing they created the hazard or knew it existed and did not fix it. Sometimes, a property owner only needs to warn a visitor of a hazard the owner knows about.

What Evidence to Preserve after a Slip and Fall Accident

Photographs

Photograph the hazard which caused you to fall. Did you slip on a puddle of water or some ice which fell from an ice machine? Did you slip because the carpet was worn to the threads or because the staircase you walked down is crumbling?

Get a picture. The property owner might not believe you really slipped on a hazard, and their insurer will want proof. Nothing is more powerful than a photograph of the hazard as it existed when you fell. Did someone drop a jar of pickles in the grocery store, and you slipped on the juice? Take out your phone and get a picture or ask someone to photograph the hazard for you.

Witnesses to the Accident

Speak to witnesses. Witnesses can also testify to what happened. Maybe they saw you slip on a hazard, or they can testify about how long it was on the floor. One issue that arises is whether the property owner should have known that there was a slip and fall hazard. If not, they might not be liable for your fall. But when a hazard exists for a long time, then the property owner should inspect the premises regularly, if they invite people to enter.
